6. OUR AGREEMENT FOR THE SALE OF GOODS AND THE ORDERING PROCESS

If you place an order, it will be subject to product availability. If there are difficulties regarding product supply or in case of lack of stock, we will send you an email informing you of the situation and the inability to ship the product(s) and will immediately refund any amount paid. Step 3 – Process Purchase

Once you have finished your order, you can proceed to process your purchase by clicking "Buy" in the upper right corner (the simplified version of your cart) or "Process Purchase Securely" within the shopping cart.

Step 4 – Complete Registration

This step will ask if you are a guest or a registered member. To register as a guest, you will need to provide an email address. We will store this information to process the order, but it will not be saved for the next time you visit the Website. Registered members will need to enter their password and email address to log in each time they place an order.

Step 5 – Complete Shipping and Billing Address

If you are already our customer and are logged in, the billing address entered previously will reappear. If you are not logged in, or if this is your first visit, you will be asked to enter a billing address. You will then need to enter your shipping address. You have the option to select the same address for billing and shipping. At this point in the process, you have the option to review the shipping option. Step 7 – Finalize Your Order

Step 8. Order Confirmation:

Once we receive confirmation that the payment has been authorized, a screen thanking you for your order will appear. Subsequently, an order reference number will be generated, and you will be sent an email confirming your order and its delivery address. The email will confirm the goods purchased, the price, and applicable shipping costs. We recommend that you keep the order confirmation for future queries. If the product is not available due to poor quality condition for sale, we will refund any amount you may have paid.

7. PRICE AND PAYMENT

7.1 The prices and shipping costs are those published on the Website when you accept the order. Prices include VAT and are in Euros. Shipping costs are shown separately. All applicable shipping costs are set on the Website at the time you place your order. The shipping cost for the order is displayed on your shopping cart page, below your selected products. This means that if you order more than one product, there are no additional shipping costs.

7.2 Prices may change at any time, but any changes will not affect orders for which an order confirmation email has been sent. Prices on our Website may differ from prices in our stores or other locations.

7.3 We accept payments via PayPal, as well as major credit and debit cards, including but not limited to: Visa, MasterCard, and Maestro. You should only use a card if you are the cardholder. Placing an order confirms that you are the designated cardholder. All credit and debit cardholders are subject to security and validation checks, as well as authorization and any other additional terms imposed by the card issuer. If the issuer does not authorize the payment, we will not accept your order and will not be liable for any delay or non-delivery.

8. RETURNS

If You Change Your Mind:

8.1 Standard Return Period: 7 days from the date you confirm receipt of the goods.

Special Terms: For goods purchased during the Black Friday promotion, the return period is extended to 30 days to give customers more time to consider.

8.2 Return Conditions

To ensure a smooth return process, returned goods must meet all of the following conditions simultaneously:

Product Condition: Unused, unwashed, undamaged by human intervention, with tags intact, and including the original packaging (including dust bags, padding, etc.).

Included Items: All free gifts, accessories, instructions, warranty cards, etc., delivered with the product must be returned together.

Documentation Required: Original proof of purchase (order screenshot or invoice) must be provided.

The following situations do not qualify for returns:

Items that have been used or damaged.

Customized or personalized goods, except in cases of product defects or shipping errors.

Goods returned after the specified return period.

8.3 Return Process (Four-Step Method)

Step 1: Submit Return Request

Log in to your account, go to "Order Center", select the order you wish to return, and click "Apply for Return".

Step 2: Review & Authorization

Our customer service team will review your application within 24-48 business hours.

Once approved, you will receive an email containing a Return Authorization Number. This number is crucial; please be sure to mark it clearly on the outside of the return package. Return packages without this authorization number will not be processed.

Step 3: Ship the Goods Back

Logistics Choice: You need to arrange to ship the goods back to the designated warehouse yourself using a reliable international logistics carrier (e.g., DHL, FedEx, UPS).

This helps avoid secondary import duties; otherwise, any costs incurred will be deducted from your refund.

Step 4: Our Receipt & Processing

Once the warehouse receives your return package, our quality inspection team will inspect it within 1-3 business days.

Once the goods are confirmed to meet the return conditions, we will immediately initiate the refund process.

8.5 Exchange Policy

We prioritize processing returns and new orders to ensure you receive new items as quickly as possible.

If you need an exchange, please first complete the return process as described above. After the refund is processed, place a new order for the desired item.

If an exchange is indeed necessary, please contact customer service. We will handle it on a case-by-case basis, but the exchange cycle may be longer.

9. OUR LIABILITY

9.2 TO THE EXTENT THAT WE ARE LIABLE TO YOU FOR BREACH OF CONTRACT, FOR NEGLIGENCE OR FOR ANY OTHER LEGAL LIABILITY IN RELATION TO THE GOODS OR THIS CONTRACT OR OTHERWISE, OUR TOTAL LIABILITY TO YOU SHALL BE LIMITED TO THREE TIMES THE PRICE OF THE GOODS WHICH ARE THE SUBJECT OF THE LIABILITY, PAID BY YOU, AND ANY FORESEEABLE LOSS AS A DIRECT CONSEQUENCE OF OUR BREACH OF CONTRACT WITH YOU.

9.3 UNLESS WE EXPLICITLY STATE OTHERWISE ELSEWHERE, WE SHALL NOT BE LIABLE FOR INDIRECT OR SPECIAL LOSSES WHICH OCCUR AS A SIDE EFFECT OR CONSEQUENCE OF ANY MAIN LOSS OR DAMAGE OR FOR ANYTHING THAT WE OR YOU COULD NOT REASONABLY ANTICIPATE. THIS INCLUDES BUT IS NOT LIMITED TO THE FOLLOWING, HOWEVER THEY ARISE:

9.3.1 LOSS OF PROFITS;

9.3.2 LOSS OF INCOME OR REVENUE;

9.3.3 LOSS OF SAVINGS;

9.3.4 LOSS OF INFORMATION;

9.3.5 LOSS OF LIQUIDITY;

9.4 If due to the nature of the goods they cannot be returned by conventional mail, you will be responsible for the cost of courier shipping. If you contact Customer Service, we will try to give you an estimated cost of shipping.

9.5 We will issue a full refund of the purchase, including standard shipping costs, within 14 days of receipt of the returned goods or proof of postage of the return shipment. If you chose to pay extra for express shipping, we will only refund the standard shipping cost. Please note that if you only want to return some of the products from your purchase and decide to keep the rest of the order, we will not refund the shipping cost.

9.6 You must take care of the products before returning the items to us. If you use them, damage them, or their condition deteriorates beyond what is necessary, it may reduce the refund amount, as the value of the item is reduced and it cannot be put back on sale.

10. SHIPPING

10.1 Orders are typically shipped within 1-3 business days.

10.2 Of course, we will do our best to ship as quickly as possible. Unless otherwise stated in the product description, goods will be shipped within 1-3 business days after payment is completed. Please note that shipping times for customized products may be extended by up to 3 business days.

10.3 We ship worldwide using the following method: Standard shipping is Global Airmail (6-9 working days delivery).

10.4 If the goods or quantity you receive is not what you ordered due to an error on our part, then you should inform us by email service@foobo.co.uk or letter using the contact details shown in Clause 8.3, as soon as possible after you receive the goods and become aware of the error. We will rectify any error. We will also refund any delivery costs you incur in sending the goods back to us. You should not use the goods you received in error and intend to return.

10.5 The goods will be delivered to the address you specified in the ordering process. However, delivery practices may vary depending on the courier delivering the goods. You must provide a valid delivery address. The delivery method we use may vary depending on the nature and number of goods. 10.6 We reserve the right to make alternative adjustments regarding shipping, which will depend on the carrier we use for the delivery of goods. This may include leaving the goods with a neighbor or in a safe place inside or near your property.

Shipping Restrictions

10.7 Due to various shipping restrictions, certain products we sell are not available for international shipping. This will be included in the product description at the time of processing your purchase, when you add the products to your cart, or we may have to cancel your order and issue a full refund.

11. OUR RIGHTS IN THE GOODS

Intellectual property rights known as intellectual property rights in the goods, including all designs, trademarks, brand names, images, and logos, are and shall remain our property or that of our licensors. No rights, title, or interest in the intellectual property rights are transferred to you at any time.

12. GENERAL

12.1 We shall not be liable to you in any way for the failure to sell goods you wish to purchase, or for a failure to fulfill our obligations under the contract, or for any costs or liabilities you may incur as a result of circumstances beyond our reasonable control, including, but not limited to, any act of God, flood, fire, trade dispute, lack of services or materials from third parties, or terrorist acts.

12.2 The contract between us is binding. You may not transfer or assign your rights or obligations to another person without our express consent. We may transfer or assign our rights and obligations under the contract or appoint third parties to assist us in performing our obligations at any time, provided that this does not reduce our obligations to you.

12.3 If any clause of this contract is in any way held to be invalid by a court or other competent authority, then all other clauses of the contract shall continue to apply.

12.4 If neither we nor you act at any time upon any rights which we have under this contract, then it shall not affect the rights of either of us to enforce any right later. If either of us chooses not to rely on a right which we have, it shall not affect the other rights which either of us has.

12.5 This contract is governed by the laws of United Kingdom, and both we and you agree that any dispute arising under or in connection with it shall be resolved by the courts of United Kingdom.

12.6 We may change these Terms and Conditions without notice. Any changes will take effect immediately after being posted on the Website and will be deemed accepted by anyone using the Website. If you have placed an order and it has been accepted, the contract will remain subject to the version of the Terms that were in force at the time you placed your order.

12.8 Any notice you send to us shall be considered delivered as follows, depending on how you send it:

12.8.3 the day it is successfully sent by email;

and in all cases the notice should be sent to the address set out in Clause 8.3.

12.10 The Contract is the complete agreement and understanding between us concerning its subject matter and shall supersede and replace any prior agreement, understanding, or arrangement, both written and oral.
